Legal Question in Employment Law in United Kingdom

Fuel Expense Claim

Hello, My company has reduced the mileage rate that I can claim for Business trips. I have a company car and used to claim 13.3pence/mile. It has been reduced to 9.6pence/mile. When I work out the rate to break even based on current fuel rates in the UK, I need to claim at least 11.4pence/mile. Therefore, with the change to 9.6p/mile, it now means I will be paying towards the fuel used for company business. Is this legal for them to basically make me pay towards company business mileage?

Thank you for your help,

Kind Regards, John

Re: Fuel Expense Claim

Hi John

The answer to your question very much depends upon the contract you have with your employer. This will presumbly deal with the payment of business mileage either at a set rate or by calculation on some formula set out in the contract.

If there is no written term in the contract to deal with mileage payment, the rate will either be as paid to others in similar positions, what is reasonable (such as in AA figures) or the rate previously paid by custom.

What is certain is that they can not get away with doing what they are doing.
