Legal Question in Employment Law in United Kingdom

Home Search

I work in the Logistics industry, there has been a lot of theft lately. The company has a stop and search policy, (including car) which i agree with.

However, they are saying they can search my property. A lot of employees are not at all happy with this. What are my legal rights and the companies legal rights?

Re: Home Search

your employers have no right to search you, your car, your property all your home unless you agree. It would seem that you will have agreed to allow them to search your person and your car presumably whilst at work. You have not however agreed for them to search your property. Without this agreement they have absolutely no right to do so and you have every entitlement to refuse to allow them to do so.

If you refuse to allow all a search of your home this may only be carried out under a search warrant issued by a magistrate usually only to a police officer.

Finally your consent to their stop and search policy can be withdrawn at any time.

Please do not hesitate to let us know if we can help further.
