Legal Question in Employment Law in United Kingdom
Resignation or redundancy ?
On 21 December 2001 the company I work for is being taken over by another company. I will have been employed by the company for 6 months. My current contract states 3 months notice on resignation. Since I will get little or no redundancy payment should I give notice after or before the 21 December and once I have given notice can i still be made redundant or do the old / new company have to honour the contractual 3 months notice ?

Re: Resignation or redundancy ?
Assuming that your contract of employment does not contain a clause giving you extra rights, you get no redundancy payments until you have been there for a year. Up to you whether you resign on 21/12. Your employer can still terminate the contract by paying the balance of the notice period/making you redundant after 21/12.
