I moved out of a flat over six months ago and the landlord checked the flat when we left. He now refuses to return the deposit and over paid rent stating we left the flat in a bad state and didn't give enough notice. The contract had ended and he had given us notice to move out after the new contract would be at a greatly increased rent level. How do i get my money back, he generally avoids our calls and was out of the country for several months.

This is a well-known abuse by landlords which has reached such epidemic proportions that a law has now been introduced whereby deposits are held by an independent party. This does not however help you. Your only available course to obtain the return of your money is likely to be to issue proceedings under the Small Claims Procedure. You should have little doubt that this will then result in your money being returned. A package with all that is required to initiate this common action is available from the legal zone website.
