Landlord damage to tenants property

I am a tennant in a rented property. A roof tile recently came off the house and damaged my vehicle. I have tried to get the landlord to pay for the repairs to my car, but he is refusing. His Landlords Liability Insurance are refusing to payout due to the inability to prove negligence on behalf of the landlord.

My letting agents tell me that the landlord should pay for the repairs regardless of whether his insurance re-imburst him or not.

I believe that as his property has damaged my property - he should make good that damage.

He and hid insurance company believes that as he was not aware that the roof was in need of repair (the property is about 7 years old).

My relocation agents tell me he is responsible whether the damage is caused by an act of god or not.

Do i have a case of getting the landlord to pay for the reapir of damage? How is the best way to achieve this if this is the case?

Whether or not your landlord's insurers will pay out in respect of this claim is quite irrelevant to you and not a matter for your concern. All that is relevant is that your property was damaged through no fault of your own by a missile belonging to another striking it. It is equally irrelevant that your landlord as owner of this missile had no knowledge of the likely risk. What your relocation agent tells you is quite correct.You are quite entitled and could hardly lose if you brought court proceedingsif he can not be persuaded to pay. Do not take the cost of repair from your rent as these circumstances do not justify that.
