Legal Question in Landlord & Tenant Law in United Kingdom
Student Housing - Unpaid bills by two of the tenants
I was living with 5 people last year in student housing, 2 of which have decided not to pay their share of the bills. Ive looked into small claims courts but I can't find anything specific to me. The bills are in my name and the companies are asking me to pay even though I have paid my share. How can I get these people to pay they're share, or is there any websites specific to this case.
Student advice said to take them to small claims - how does it work? Will I have to pay legal costs? Can I claim for all the bills as well court costs and money for phone bills and time taken etc. Will I def win... as they have both signed a contract with the landlord saying that they have to pay their share of the bills and I can get proof that ive paid my share.
Thanks

There is a clear liability on your former tenants to reimburse you for monies you have paid on their account. This is a matter quite suitable for a claim in the small claims division of your local County Court and I can see little alternative to you bringing such an action if you wish to reclaim the money.
The procedure is quite straight forward. Legal costs are not recoverable but you will be able to recover the court issue fee which you will have to pay. Your claim will include all monies that you have paid out and although there can never be any guarantee of success, I can see no reason why you should not obtain a judgment.
We have a section on small claims at our web site www.legal-zone and also provide a kit for a nominal price to enable people to bring their own claims.
Please do not hesitate to contact us if further information or assistance is required.
