Limitations Period

Hi there,

I understand that there's a 3 year limitations period for personal injury cases.

Does the limitations act require that proceedings in the court be commenced within that limitation period, or that a letter of claim be sent?

For e.g if the letter of claim is sent 3 days before the expiry date (3 years) will that be safe?

Proceedings in a claim for personal injury must indeed be commenced within three years of the event giving rise to the claim. Sending a letter of claim is not the same as issuing proceedings, but in exceptional circumstances it could lead a court to extend the limitation period as they have the power to do.
