Legal Question in Personal Injury in United Kingdom

Unsure

I had a claim that went through the courts and i was awarded a sum of money. I was also entitled to legal aid so that was the bills taken care of but i was told that a sum of the money would be held back until they had sorted out how much my case had cost incase there was any bills that would be paid out of that money, and i was told that i would recieve it in around 6 to 8 weeks but since then i have spoke to my solicitor and he said it would take a bit longer and now it has been nearly 9 months and he keeps telling me the same thing and still has 30,000 of my money is this right can they hold the money for this long.

Re: Unsure

This is very worrying. Nine months is ridiculous and even 6 to 8 weeks is longer than is really necessary to sort out the costs of a case and amount repayable to the legal aid fund. I am also a little confused as you clearly won your case. This should mean that the other side will meet your legal costs and therefore be able to satisfy the statutory charge re- payable under your legal aid.

You are entitled to your money and entitled to it now. These problems should be taken up with the Law Society and with the Legal Services Commission. If I can help further please let me know
