Creditors

My Brother died leaving a house which was sold. A court decided how the money would be split.

The money was split:half to his ex-wife: the other half split between his 3 children.

One of the children is under the age of 18.

A solicitor dealt with the transactions.

On receiving the money in their bank accounts the children found that £12000(twelve thousand) had been deducted from their monies for a Credit Card Bill of their fathers.

They did not know anything about this Bill. They said their father did not have a Credit Card.

But ignoring that point; did the solicitor have the right to pay this Bill; should he not have consulted them first; should the ex-wife have paid some of this bill; can the Credit Card Company just be paid out without them putting in a claim.

I would be grateful for any other information you could give me concerning this matter.

The answer to this is almost certainly yes as it is probable that the solicitor will have a duty of care towards all beneficiaries of the estate.

however this is clearly a long-running and complex matter and before advising conclusively much further information would be required. Please let us know if you would like us to help further
