Legal Question in Wills and Trusts in United Kingdom

Debtor

I owed a money to man I borrowed from directly for a business venture that failed. I have been paying him every month an agreed amount sanctioned by the courts. This man died in October, 2005. I was told by his office that I still have to pay his estate. I feel uncomfortable paying this money to people I do not know without any directive from the courts. His will has not been probated and I have not had any legal directives. Am I supposed to be paying this money to a dead man? or do I wait until I have a legal directive as to what should be done?

I am afraid that your liability for this debt does not end on the death of the creditor. the money judged as owing to him is now due to his estate and must be paid to his executor. Strictly speaking this executor cannot call upon you to pay the money until he has obtained a grant of probate, but once he has done so and produced a copy to you, your obligation will be to pay him as before.
