inheritance of home shared with sister
My mum and dads home will be left to my sister and myself after mum has passed away. Dad died some two years ago.This bequest is in a will.
My sister will now be living with my mum. when mum dies will my sister have to pay my share of the property to me, or can she continue living there without the will being put into force untill such time as the house is sold or my sister dies.

Re: inheritance of home shared with sister
On the death of your mother her entire estate including the house will pass to her executors to deal with in accordance with the terms of the will. This provides that you are beneficially entitled to a half share of the estate and you may call for this to be paid to you as soon as practicable. If this requires a sale of the house then this must take place inorder to raise the monies to pay you your entitlement. Your sister will obviously have to move out so the property can be sold with vacant possesion
