residuary legatee
Our family is having a difficult time getting everybody to agree to pay the fees for my mother's care in the nursing home. I want to prevent the case from getting into the converson and expensive legalities of probate court, warship and so on. So, my questions
- As indicated in my father's will my mother and attorney Walsh are the chosen executors. However, my mother mental health has deteriorated drastically which prevents her from acting legally. Also Ms. Walsh renounced her right to act as an executor since August 2001. Regarding this issue someone told us that the persons named as residuary legatees in the will (my sisters) would automatically become executors of the estate. Is that true?
- Do these residuary legatees have the right to get a credit line exclusively base on the properties included in the estate to pay for the past due and future bills?
- What do you recommend I do and what is the cost of your services?

No it is not. The next of kin would be in line to petition the court to be named personal representative.
