Legal Question in Wills and Trusts in United Kingdom

Will - where one beneficiary is deceased

Quote from Will:

''I DEVISE AND BEQUEATH all the rest residue and remainder of my real and personal estate whatsoever and whersoever after payment thereout of my just debts and funeral and testamentary expenses to my Trustees upon trust to sell call in and convert the same into ready money with power at their absolute discretion to postpone such sale calling in and conversion and to stand possessed of the net proceeds thereof in trust for my daughter X and my grandson Y in equal shares per stirpes or the survivor of them absolutely''

Daughter X is deceased. Grandson Y is still living and is ''the survivor of them (that is to say, Daughter X and Grandson Y) absolutely'' Who is due the estate?

Many thanks.

Re: Will - where one beneficiary is deceased

If daughter X died before the testator then the gift to her will lapse and the entire residue of the estate will pass to grandson Y.If there are any further queries with this estate please let us know and we will endeavour to help.
