Will Challenge

Mother died june 2004..stepchildren challenging will..suggesting fraudulent signature ..put a charge on Mums property Dec2004 so that I cant sell it..May 2005 they requested late mums cheques to compare signatures..judge so ordered Bank giving them 7 days to comply.. offered stepchildren(may 2005) to revert back to earlier will which stated equal shares of mums estate..heard nothing at all for5 months.Estate value less than �50000. I am the executor and main beneficiary..daughter

Reading what you say this sounds like a prime case for an immediate application to the court that the application by the stepchildren be struck out and that they pay you appropriate damages for the cost and inconvenience you have suffered by way of their application.

You will appreciate that without further information I am unable to advise on the merits of the case but there is clearly sufficient delay on the part of the claimants to warrant a striking out.

This is a matter which clearly needs to be resolved. I will be happy to advise further if you care to get in touch.
