Rules and regulations for a withholding agent is found in Title 26, section 7701. They are usually government employees as defined below so any lawsuit must be filed in federal court.
Withholding agent.- The term ''withholding agent'' means any person required to deduct and withhold any tax under the provisions of sections 1441, 1442, 1443, or 1461.
