Legal Question in Consumer Law in United States

Bought a 2003 Audi A4 with a 1.8T engine from a Nissan dealer in Winchester VA. At the time of purchase I bought a service plan with the dealership. They changed the oil and did regular maintenance on the car for the 1st year I owned it. I had multiple minor problems with the car during that year and was not happy with the service department. As a result, I started taking it two an import dealer to get the maintenance completed. They told they believed that Nissan had been putting none synthetic oil in the car. This is a problem with Audi?s because of known sludge problems.

To make a long story short, I?ve been taking the car to the import dealer for the last year. A few weeks ago the check engine light came on and the car stalled. I had it towed to the import dealer and was told after a few weeks that it need a brand new engine. They suspect that a sludge problem led to the engine not getting lubricated. However, they can?t say for sure. I just spent $6300.00 replacing the engine. I?ve done the regular scheduled maintenance on the car the entire time of owned it. Is there anything I can do to get refunded for the engine? Do I have any options?

Sure, you could sue the Nissan dealer in small claims court for up to $5K, but there would seem to be a problem with proving that the dealer's alleged negligence in servicing the vehicle actually was responsible for the later engine failure which you've described.
