Copyright question

If you take a photo of a DVD cover, do you have the rights?

The DVD cover, (let's say Star Wars), is owned by someone. But if I take a photo of the cover, what happens?

A few things.

(1) You have basically just made a copy of the DVD cover, so the owner of rights in the DVD cover also has some rights in your photograph;

(2) You, as the photographer have rights to that specific photograph and any copies made of it, but you cannot prevent someone else from taking a photo of the DVD cover;

(3) If you took a photo where the DVD cover happens to be in the background but is not the subject of the photograph, then you are probably in the clear.
