Child Support Amendment - Moving Back to Same City as Mother

I divorced my wife in December of

2006. We agreed to joint custody,

with her as the primary residential

custodian. However, this was decided

according to the fact that before I

divorced her we were Americans

living in China (for my employment)

and she was planning on returning to

the US. We wanted my 8 year old

son to be US-educated from that

point on. I remained in China.

In June of this year I will be

permanently returning to the US -

same city and school district as my

ex-wife and son. My question is this:

Since our circumstances will change

and we will be living in the same area

only minutes from one another and I

will physically have custody of my

son around 50% of the time now, do

I have a reasonable chance of

success at reducing child-support

payments? I will be a resident of

Jefferson County in Louisville,

Kentucky (as I previously was before

moving to China).

It is within the discretion of the trial court at this time, but generally most courts do take into account shared equal time as a reason to reduce child support obligations depending on the parties' incomes and other needs of the child(ren).
