Beneficiary

My father died and left his 2 children as beneficiaries. He had a will. Why is it necessary to go through an attorney to get his assets. His wfe past 2yrs ago and had no children. Some of his investments have no beneficiary.

There's not really enough information here, but in general, it depends on what the assets are. You may need to probate the Will in order for the Executor to have the authority to get possession of assets such as bank accounts and the proceeds of the insurance policies.

An affidavit of heirship will work unless the terms of the will are different from the laws of intestate succession.
