Legal Question in Credit and Debt Law in United States Virgin Islands

Responsible for deceased mother's debts?

My mother died almost five years ago and I recently recieved a notice from a collection agency trying to get payment for a service that was performed for myself. There was not a probate because she had no property or assests and I'm her only child. I did not sign anything accepting responsibility for payment of this service, my mother accepted responsiblility for that. I was 19 at the time. Am I responsible for this or any of her debts? I was told I was not and am puzzled why this hospital is trying to collect through me.

Re: Responsible for deceased mother's debts?

Based on your staement of facts, it appears that the statute of limitations has expired. Continued efforts at collection may be a violation of the provisions of the Fair Debt Collection Practices Act. I urge you to consult with a competent creditors' rights atty in your locale.
