Legal Question in Wills and Trusts in United States Virgin Islands
real estate in probate
my ex-husband and I owned a home jointly that I paid to be built during our marriage. He has an adult daughter from a previous relationship and we have two minor children together. He recently passed away without a will. What is the disposition on our home. His daughter and family moved in the day after his death.

Re: real estate in probate
There is a law that governs the process of descent and distribution for those who pass away without a will. You probably need to open an estate in probate court. Please feel free to contact me if you would like to discuss this matter further. Edward DiCato

If you owned the house as joint tenants with right of survivorship then upon his death you would become the sole owner of the real estate.
