Legal Question in Administrative Law in Utah
criminal record expungement
I have been denied my state professional license to practice massage therapy due to criminal charges which have been dismissed by way of a plea held in abeyance. If my expungement application is approved, can the state still deny my license based on that criminal record?

Re: criminal record expungement
Under a plea in abeyance the charges and your guilty plea are held for a period of time. If, during that period, you have kept the terms of the plea agreement, then the charges and your plea are dismissed. There is no conviction.
