Legal Question in Banking Law in Utah
cashing a bad check
My wife wrote a check to a contractor for more money than he was owed. I know the guy was unscrupulous and I put a stop payment on the check and notified him that the check was no good. He was still able to get it cashed because our bank didn't process the stop quick enough. Is it illegal to cash a check you know is bad or is written incorrectly?

If he was not entitled to the funds, sue him for the difference. You can sue in small claims court if the amount is less than $5000.
