Legal Question in Banking Law in Utah

stolen checks & fraud check

my sons checkbook was taken out of

his glove compartment. Checks were

written that added up to $2,800.

(his line of credit was used also)

checks started bouncing before he

noticed. He has tried to clear this up

with his bank branch. He thought it

was.But it wasn't.He tried again.

Then he started getting calls from

the bank,stating he owed the

amount. When he didn't pay it they

turned it over to a collection. They

have called me (his mother)& my

daughter.My son is vacationing in

the mountains and I can't reach him

till Monday.The woman who called

me told me if it isn't paid today

(yesterday) a warrent for his arrest

would be taken out on him. I'm

worried sick.I live in WI. he lives in

UT.

We got him out of debts that he

racked up ten years ago, when he

was in college. We did this 2 yrs. ago

hoping to start repairing his

credit,which of course is awful---then

this nightmere started.

Who should I contact for help guide

him?

Re: stolen checks & fraud check

First: Has he filed a police report re: theft?

He should also make an insurance claim (Homeowners or renters ins.)

Second: He ( or his attorney ) should write the bank and any 3rd party collection agencies to Cease and Desist all further communications except to his attorney.

Third: The bank account holder agreement should be reviewed for liability for forged checks which should have been dishonored by the bank.
