Can we use another attorney?

I have a client who filed a chapter 13 bankruptcy 3 years ago. He has since been transferred to another part of the state. We have an offer on their home. After numerous calls to their attorney in order to file a motion with the court to sale their home we have never received a return phone call. They have spoken to the assistant in charge of their case only when they have refused to get off the phone without talking to a real person and not her voicemail. She has told them she would call back, send them papers, relay messages to their attorney etc. To our knowledge she has never done one of the things she said she would. Where do we go from here? Can they get another attorney to file the motion?

When a person hires an attorney and later wants to fire that attorney they have the right to do that. There usually is an issue of attorney fees which need to be settled, but they can fire an attorney if they are unhappy with him or her. This also depends on the engagement agreement that the attorney and the client entered into.
