Legal Question in Bankruptcy in Utah

filed for chapter 13

I recently filed for chapter 13,and was pay 305.00 a month to the trustee,Unfortunaly my work cut my hours considerbly,And I'm not able to meet my obligation,should I contact my lawyer because i know he wants to be paid,I'm very worried,what ramifications should I expect.

Contact your lawyer, he is probably being paid as part of your plan. You will need to refile a new plan or convert to Chapter 7.

Short answer -- contact your lawyer so he can file the necessary paperwork to reduce your Ch. 13 payments.

It sounds like you have a real change of circumstances since the time you proposed or confirmed your Ch. 13 plan. You likely qualify to have your plan payments reduced. Contact your attorney BECAUSE HE WORKS FOR YOU! He/She cannot help you unless you communicate. If you do nothing I can assure you your case will eventually be dismissed for failure to make your Ch. 13 payments.

Another option you must consider is whether you should even attempt to reorganize in Ch. 13. Maybe if you look at your situation honestly, you may come to realize you should have filed under Ch. 7. Your attorney can file a motion to convert your case from a Ch. 13 proceeding to a case under Ch. 7. I don't know your specific situation but I advise my clients as a general rule to file Ch. 13 ONLY if they are far behind on their house or car payments. ph. (800) 303-0720
