Legal Question in Bankruptcy in Utah

Filing of a Chapter 13

I filed a chapter 13 in February of 1998, I now have 11K in taxes that are due and I can not pay them. I do not want to lose my home. My income is very good 150K annually, but I am a very poor money manger, can I refile?

Re: Filing of a Chapter 13

You may be able to dismiss and re-file, but you should be asking the lawyer who represents you in your Chapter 13, not a computer bulletin board. Your lawyer has full information on your case, which we don't. That's what your lawyer is there for.

Re: Filing of a Chapter 13

Probably - if you completed the first filing. If not you will need to petition to reopen the filing and propose a new plan.

If you owe only taxes you should be able to work out a payment program with the taxing agency or agencies. That would be better than bankruptcy.

Call if you want to discuss this.
