Garnishment of Wages

My employer received a garnishment of wages (someone coming to her home to serve the garnishment). I was told about it the garnishment the next day. She was not home and the papers were not left.

I have not received any notice of this garnishment. Can you tell me if I am supposed to be notified first before my employer. And if so, how ... summons coming to my home or via mail?

You should be given a copy of the notice of garnishment either by your employer or the garnishor (the person to whom you owe the debt). You can file a notice of exemptions, (see Utah Code Ann. 78-23-5 following sections for a list of exempt property and values). The garnishment documents also should note that you cannot be garnished so that you earn less than minimum wage. You can request a court hearing and order if you are concerned that the creditor is taking more then it is entitled.
