Legal Question in Bankruptcy in Utah
Married woman filing bankruptcy
If a married woman files bankruptcy in just her name, what happens to a mortgage loan that is in both names? Can and will the husband be able to retain the home and continue to make the payments? With their limited income, they cannot keep both.

Re: Married woman filing bankruptcy
The person who files and is discharged in bankruptcy is removed from liability on a debt. If there is another cosigner then that person is still liable for the debt.
