Employee Reimbursement

Hi,

At the time of joining, my employer had promised me that they will file Green Card (permenant residency) after completing 4 months with them. But even after completing 7 months with them thaey have not filed my GC. Now I quite my job and joined a new employer. My employer has deducted about 4000 dollers from my final settlement towards relocation expenses. Can they do that?

I joined only because they said they will file my GC, otherwise I would not have joined them. Since they have not done that why should I pay for the relocation expenses? Can I take legal action against them and get my money back? Please advice.

Since you need a green card you must not be an American citizen. Until you have a green card you are not authorized under the law to work in the U.S. You are breaking the law and so is your employer. You should report your employers to Immigration and Customs Enforcement (I.C.E.) Since the contract between you and your employers was based on illegal acts, you will not likely have any recourse in the U.S. courts.
