Legal Question in Business Law in Utah
I sent the following question to my human resources department. If a resolution is not met and I am fired for not working Sundays, would I be able to collect unemployment with the information below.
To whom it may concern
When I was originally hired, I informed my hiring managers that I would not take the position if I was required to work Sundays. In January of 2010, I was offered a promotion by my current managers. Upon the interview for the promotion, I was asked if I would be willing to work Sundays. I informed them that if it meant working Sundays, I would not take the position. They agreed that it was not necessary for me to work Sundays and gave me the promotion and my current job title of customer service lead. This is done so that I might observe my religious beliefs and attend my church. Other than
However, they have decided to void our agreement and force me to work sundays despite the fact there are others who can fill this need without religious conflict and have been doing that very thing for some time. Further more, they have scheduled me in a way that would force me to choose between going to church and going to work.
I feel that it is reasonable for the agreement to be kept, that the company has the proper resources to reasonably allow me to continue following my religious beliefs, that I have made more than acceptable notifications with acceptable clarity and reasonable foresight and that failure to meet my needs would be both unreasonable and a breech of verbal agreement established before the hire date and before the promotion date of my current position.
I would ask for remedy in the form of preserving and maintaining the still reasonable condition of employment set forth and accepted by all parties.

That decision would be made by the unemployment compensation appeals board.
