Legal Question in Business Law in Utah
I recently paid a photographer to take some lingerie photos of me as a birthday gift for my boyfriend. I stupidly signed a model release form without fully understanding it. I had added to the form that photos not be added to facebook. I found that these pictures are online. I emailed the photographer asking if we could terminate the release and if I could purchase the right to my photos. He has yet to respond. How would I go about terminating the agreement? Since he posted some of the photos on facebook does that terminate the agreement?

As a franchise attorney I can say it appears his posting of your photos on facebook is a breach of your release. Whether that entitles you to sue him for damages or rescind the entire release depends on an analysis of the document you signed, as well as all surrounding facts and circumstances. Consult with a good business or franchise attorney in your area for specific advice.
