State Funded Daycare Fraud

I am a Home daycare provider in the state of Utah. I provided care for a lady with two children, who was state funded. She was frauding the state of funds without my knowledge. The state pays in the form of a two party check. I rarely saw the amounts on the check. When I realized what she was doing I terminated care, and reported to the state. About three months ago the state sent an investigator to my home and he asked for my records. Since I have nothing to hide, I gave them to him. We went over them together and realized that she was recieving between $200-$300 extra per month. Yesterday her daughter told her that kids at school were teasing her about her mom being sued. She immediatly thought it was my son and came to my house and verbally attacked him. (He is 12) So my questions are: what can I do to keep her away from my son, and even though I had no knowledge of how she was frauding the government could I be liable to pay money back that I may have recieved. I Charged her anywhere from $126 per month to $262 per month and she was recieving way more than that and only paying what I charge.

If she continues to harass your son, you may apply for a restraining order against her through your local district court. If she continues after the issuance of the restraining order then you can have her arrested.

It is not likely that the state will require you to repay funds since you did not have knowledge of the fraud. The state will require her to repay the overcharge, or may even file criminal charges against her.
