Legal Question in Business Law in Utah

trademark

Am I assuming correctly that I can use the TM symbol just by having my logo printed on business material? What is the advantage of having a logo or business name registered? If I were to start a clothing company, would each different graphic or design need to be trademarked? Also if a business trademarked ''XYZ'' as an acroynym for a service, could a different business use ''XYZ'' for an acroynym for unrelated service? Thanks

Re: trademark

Trademarks can be obtained on a state by state basis and/or from the US Government. The trademark then belongs solely to you. If a state trademark then no other business in the state can use the mark. If you get a federal trademark it is good for the US. You cannot use the TM mark unless you have obtained a trademark from a state or federal government. Designs are covered by copyrights, which you obtain when you "publish" or make public a design. You need to keep records of the publishing of a copyright.
