Trouble locating company I need to sue

I am trying to file a small claims suit against a company for breach of contract. The problem is that I only have the phone number and not the address, so I cannot tell the process server where to go. When I call to get the address, the secretary says she is not allowed to give out that info. She says I have to talk to her boss, but he is either ''in a meeting'' or ''on another call'' and never returns the voicemail messages I leave for him. I only know that they are located in Salt Lake City, UT.

Is there a way I can force them to give me the address or another way for me to get it?

Contact (online or phone) the Utah Department of Corporations. They have address for registered businesses.

If the business is incorporated, the Utah Secretary of State should be able to provide you with the name and address of its regustered agent for service of process. It seems to me that if you are using a competent, registered process server, they could have handled this question for you. If the business is unincorporated, I would begin the inquiry at the county level, as in most states businesses other than corporations must file their name with the county clerk and/or obtain a business license.

There are also "reverse" telephone directories, some still free, where you can inquire by phone number and get the name and address of the subscriber; unfortunately, this only works with listed numbers and these people seem to be so secretive that their number may be unlisted.

I assume you have studied the jurisdiction issues that may arise in trying to sue a Utah-based business in a California court, especially small claims. If not, get a self-help law book covering small-claims procedures.

The Utah Secretary of State's website is

http://www.commerce.state.ut.us/

You can also type the area code and phone number (spaces and dashes are not necessary) into google.com. If the number is a listed number (not an unlisted on) then you will get the number and the address associated with that number.

Call the Utah Secretary of State or Department of Corporations. They should have a Registered Agent for Service of Process listed for the company, if it is doing business in Utah. You then need to serve the Registered Agent.
