Legal Question in Business Law in Utah

We have a waste removal company in Utah. We have several clients that are 30 and 30+ days behind. How much can you legally charge for an across the board late fee without having to do a seperate fee for each client?

What does your contract say? If the contract does not address the issue, you can't change the contract unilaterally. The best you could do would be to give them thirty days notice that you are charging a late fee for any future late payments, and if they want to get out of the contract, they have that opportunity.

As a Franchise Attorney I agree with the other attorney answer. If your contract provides for late fees, that's one thing. If it doesn't, you need to address this issue before assessing any late fees. Consult with a good business or franchise attorney in your area for specific advice.
