Legal Question in Civil Rights Law in Utah
my kids got into a domestic violence altercation. Upon which, my son left the house and went to a friends house. his wife called the police and came to the house. they asked if there was a gun in the house and confiscated his gun. it was not used during the altercation. it was not loaded, it was put away, and the police still took the gun. he later found out about the police taking his gun 3 weeks after the fact. he still has not been charged with anything yet. can the police take his gun still? Was his civil rights violated?

Initially, they are usually permitted to take a gun. However, if criminal charges are never filed, they should return it to him.
