Public game servers hosted on the Internet

When a game server is hosted on the internet as a public game server allowing anyone to join yet it bans/denies specific people from playing on the server for any reason they dream up. Is there recourse or any action that can be taken against the server or operators? Can the game company be liable for implementing a function that allows this to happen on a public server?

Unless you have a contract with the service provider they can deny service to whomever.
