Website Theft
What steps need to be taken if a competing website and ex-website designer steal code from your server and build a new competing website with your code? We spent over 30k for this site and now it has been stolen. Can we press charges for theft?

Probably yes if the code is protectible. Where is the competing website located?

You can sue for theft, conversion and fraud and may be able to get your attorney fees as well. You will have to prove that the code was yours and that the person that took it had no rights to it. You may also want to file criminal charges. You may call for a free consultation.

Frankly I would need to know more facts because this could go either way for various reasons. There are also various ways to address this type of situation. The courts (state and federal) are an option but there are others depending on the specific facts. I focus on Internet matters and am an experience trial attorney, which helps when dealing with attorneys that know they don't know how to go to trial. My guess is that UT is not the only place this could go to trial and the other significant entities are almost assuredly not in UT. So feel free to contact me for a free consult.
