Even though they don't live together, if a wife has access to her husbands email account, and on it there is evidence that he is dating other women, can she use his email's in the divorce proceedings? Is that against his rights?

She can, but it is not necessary. Utah has a no fault divorce law. Either party can get a divorce from the other for any reason whatsoever.
