Legal Question in Construction Law in Utah
Brand new home has flood twice due to builders mistakes.
We built a home and we moved in not quite a year ago. We have had two instances of floods. The first one was due to that fact that the windows were NOT sealed and water came into my finished basement - the second time was about a week ago - apparently the builder nailed in the base board for my laundry room on the main floor and the nail nicked the hot water PVC pipe, which over time eventually worked its way through and punctured a hole causing my main floor to flood which then water seeped down into the other side of my finished basement. I am upset for obvious reasons and wonder what I can do to compel the builder to reimburse me for the future loss I will incur when I go to sell my home in the future - as I will have to disclose the fact that there was water into or through my home twice. They still have not properly sealed my windows and the carpet that sat in water they simply replaced the pad and laid the dried carpet back down. I am only one of many who have experienced similar issues. What can I legally do?

File suit against the builder. These kinds of complaints are not uncommon. The builder has a duty to provide a house without such defects, and is responsible to properly repair the house AND to reimburse you for your damage, such as cleaning and/or replacing carpet etc. You should not delay in taking action, as you may lose the right to sue.
