contract/stop payment
hired a company to do some work installing a COLD AIR RETURN from my basement to my upstairs.. He promised me that it would make a night and day difference in my upstairs. He guy proceeded to cut sheet rock or drywall whereever he felt like leaving my house a mess....when my husband got home and say the job that he had done he called the guy up to complain and asked him to come back and fix all the problems. He said he would be back in a few days.
He never came back. So I put a stop payment on the check and now he is trying to sue me for putting a stop payment on the check when he refused to come back to fix the job.
Please let me know what I can do. I would like to counter sue him for the crappy job that he did on my house. I have had other companies come out and look at the job he did and they just laugh.

He can sue for 3 times the amount of the check - you will need to file a countersuit, in which you can ask for an offset for the damages he did. Call for a free consultation.
