Failure to build home as per contract
I currently have a home being built in Vernal. The original contractor stopped production and another contractor was assigned to finish the build. It has now been an 18 month process to finish this home and the contractor has already been paid all of the draws from the bank. The home still has not been finished completely as per industry standards. We are now paying a mortgage on this home due to the maturity of the construction loan. There were no penalties stated in the original contract. The only draw request and approval that was signed by me personally was the first. There were many issued after that draw request/approval with a ''signature'' on them. Even though there were no penalties call out in the contract, is there anything that I can do to rectify this or possibly issue backcharges to the contractor or the bank? If so, who should be held responsible for this?

If you have supporting documents you can sue the contractor for breach of contract; if he forged your name/signature on draws he is liable for criminal and civil fraud. You may also be entitled to attorney fees. You may call for a free consultation.
