Release of Mechanic's Lien

Greetings:

Twenty-four months ago an attorney for an Ogden cement company put a Mechanic�s lien on my home. He did so as my landscaping contractor (whom I paid) did not pay the subcontractor for a cement walkway installed on my property. The amount was less than $600.00 and no action was ever taken to enforce the lien in court. From my research I learned that they claimant has 180 days in which to bring legal action to enforce the lien otherwise the lien is no longer valid. Question: Is the claimant�s attorney now obligated to file the paperwork to remove the lien from my home?

Yes, and if he does not then threaten him with a wrongful lien and treble damages including your attorney's fee.
