Legal Question in Construction Law in Utah
waranty 1 year
i give a one year waranty. i do asphalt work. i did a lot of work in 2007 for 1 guy, the next winter all winter long he has the snow plow guys put 1/4'' of salt on all the asphalt and concrete, the next spring he trys to get me to redo my work that he said was bad. he had new cracks all the striping and seal-coat was wear off. the paint company and the seal-coat supplyer both said it was from over salting the property. i spend 30,000 doing warrany work, which i didn't belive was my fault, but i didn't reseal the parking lots, only re striping and recrack filling new cracks now 18-24 months later they {hoa's}want to sue me! do i need to get in writing from my supplier's it was the property manager fault? sent letters getting him in trouble, he has already stated he would never do business with me again! i bent backwards with this guy. because i was to do 500,000 more work this year , but i only did 10,000 with him. my whole year i did under 100,000 this year. last year i did 300,000 with him. i have no assets. i have a LLC HAS HIS TIME RUN OUT!

Re: waranty 1 year
If the salt would destroy the asphalt and if the HOA knew or should have known, then their suit will not succeed. If they used an unforseeable amount of salt, then their suit will not succeed. Your case has a lot of specific facts which limit any answer here. You may call for a free consultation.
BTW the LLC will protect you from any personal liability.
