Legal Question in Consumer Law in Utah
Automobile Purchase Contract
I purchased a used car from a dealer. The dealer and I agreed that needed repairs to the front bumper would be done, and a verbal agreement to install a sun roof for free was also included. The dealer called six days later saying the car was ready. However, the sunroof wasn't there. The Sales Manager said it was not included, and the salesman did not have the authorization to include the sunroof as part of the deal. The Sales Manager did acknowledge that the salesman had admitted to making the deal. I signed a purchase agreement and left a $4000 deposit on the car, but DID NOT accept it after the repair. I approached the General Manager and talked to him. He offered another vehicle, but he insists I forfeit all costs associated with the first vehicle ($1000+).Am I stuck with the costs of the first vehicle even though I never did a final acceptance?
THANKS!

Re: Automobile Purchase Contract
Tell the sales manager that you are not going to do business with them, and to return your money. If they refuse to return all of your money, then you will have to sue for the remainder. Hopefully you have a witness, and hopefully the dealer and salesman will be honest in court. Take the matter to small claims court, which does not require an attorney. In the future NEVER make any deal based solely on oral agreement.
