Re: Buyer's Remorse Law

I agreed to a purchase from a company on a Wednesday night. On Thursday, payment arrangements were made, and they mailed the materials to me, which I then received on the following Monday. I looked over the materials the next day, Tuesday. On Wednesday (now a week later), I called them to question whether or not the ''package'' was supposed to contain an item that was ''purportedly'' part of the package--I also stated that if it was not part of the package, it was not going to do me any good, and that I would cancel the sale. I received an answer on Friday that it was not part of the package--I then asked to cancel and was told to set up a ''cancellation appointment'', which was on the following Tuesday (today--now almost two weeks later).

Now they are telling me that I did not initiate my questions and/or cancelling of the sale within the 3 day ''Buyer's Remorse'' period, and that the remorse period started on the Wednesday when the purchase agreement was made, not from the actual payment date. Is this true? And, this does not account for a period of time to look the materials over?

I would state that if this happened in Utah, then you should question a Utah attorney. If not, you usually have three days from the receipt of the goods, however, even this can be extended in certain cases. There are federal laws protecting you if this does cross state lines. It seems to me you did initiate your complaint within the grace period allowable. I would suggest sending them a letter from an attorney to start.
