Legal Question in Consumer Law in Utah

Car Repair Taking Too Long

I have a car that's being repaired. It was only supposed to take about one day, but it's almost been a week. They are having trouble fixing the car and I suspect that they replaced a part that didn't need to be replaced (it's covered under warranty, so it's not too big of a deal). I need my car back soon. If they cannot repair it within a reasonable amount of time, am I within my rights to ask for them to return my car with the original parts on it so that I can have it repaired elsewhere? Also, can they legally keep my car and try to make me pay even though the car hasn't been fixed? I have had problems in the past with this dealer personally and so have other family members. My wife's uncle had to call the police to get them to return his car to him. I'm wondering if I'm within my rights to do the same, if it comes down to it. Thanks.

Re: Car Repair Taking Too Long

You can demand the return of your car and take it to another dealer or place of repair. You will probably have to pay for the work which they have performed. Make sure you understand what the actual reason is that the car is not repaired. If it is because the dealer cannot get a critical part, then it may not help going to another dealer. If it is because they don't have time to get to it, then you may want to give them one day to repair or get it out of their shop so you can take it elsewhere.
