Legal Question in Consumer Law in Utah
used car sales manager signed it
the salesman asked how much we wanted to spend, I told him I would like the best vehicle I can get with the payment being no higher than 250.00 with 4000.00 down. so we found the ''right car'' for our situation while working the deal the manager came back saying that they could do this: pay the 4000.00 down and pay two payments of 370.00 then they would refinance the vehicle for the rest of the term of the loan to be 256.00 a month which was fine with me so I told him to put it in writing and sign it, then we could close the deal. and he did just that. I made my two payments of 370.00 and went back into the dealer to get the refinancing I was promised. where I was told there was nothing they could do as far as refinancing me because I had too much negative equity and the vehicle was too old. what are my options? I'm almost certain I could sue them for the difference in payment for the course of the loan but is there anything else I could do? punitive damages? fraud? I don't really want or need the money but I would like to send a message that this should not be tolerated as i'm sure there has been many other people that were told the same thing I was about refinancing but didn't get it in writing...(my sister is one of them)

You can sue them for specific performance (requires them to refinance the car); can sue them for fraud, intentional and negligent misrepresentation; your damages might be hard to prove however.
