Legal Question in Consumer Law in Utah
Clinic registration legal?
The clinic that we take our children to has some language on it's registration that I would like an opinion on. Above the signature line, it states: ''I agree to pay for all charges incurred including reasonable collection costs and reasonable attorneys' fees and {other fees described above (see next paragraph)}.'' (Are attorneys' fees assessed before or after they win in court?)
'' . . . patient agrees to pay costs of collection, court costs, attorneys' fees. A collection cost of 21 to 50% of the original balance will be assessed to your account should the matter be assigned to a collection agency.''

The language is probably legal. There is some dispute that collection costs must be directly related to the actual costs of collection, which may affect that paragraph. Attorney fees are usually added on when the matter is litigated, although some attorneys tack on attorney fees when they get the matter.
